The application is now "Approved For Publication", which means it will be published on the Official Gazette, and then there's a 30-day period in which anyone can file an objection if they consider this application is hurting their business.

https://trademarks.justia.com/865/02/sugababes-86502014.html

If no one files any complaint, the trademark is hers.

This website explains the whole process: http://www.uspto.gov/trademarks-getting-st...at-happens-next

It's for the US rights to the brand. There's still rumours floating around that some form of deal has been done for the EU mark and that they've got that so will be relaunching as the babes rather than as MKS.

I think the 'rumours' is just how the Madrid Protocol works.

Keisha is officially the owner of the Sugababes brand in the US now: http://tsdr.uspto.gov/documentviewer?caseI...ex=0&page=1

That document has been signed today, so the websites will take a few days to present the new status.

The application for the rights to use the name in the EU is still going: http://trademark.markify.com/trademarks/ct...babes/014770408

Does that seriously have her home address available for anyone in the public domain to see it? unsure.gif

It's more likely to be the address of her legal representation, in case someone needs to get in contact with her.

Yeah very unlikely to be her home address. This is a positive move though. It means Crown haven't contested it, or if they have then they lost the case.

I'm guessing she filed the EU rights when she knew she was winning the US case and is using it as a leverage that she should get the rights.

What's she gonna do with it? To be fair, and I say this as a long time fan, I'm completely over them by now. I don't think anybody is waiting for a Sugababes return.

That is sadly very true. I think MKS had their chance to make an impression and blew it.

Crown have contested the EU application on grounds that they already own it. K's leverage is the recent granting of the US trademark and the fact that Crown haven't released anything since they had to give Freederm away for free nearly 5 years ago. (Lack of activity for 5 years = lost trademark)

Crown's objections are not likely to hold water given their lack of activity with the brand so it's a case of waiting for that process to go through in the EU courts. The deadline for opposition is late March so it could be mid-late summer before its awarded.

In fairness, I think the vast majority of the general public won't have even been aware of their comeback attempt the first time around.

This is true. Flatline did flatline upon release, not that Polydor helped matters there...

So technically Crown own the trademark until at least September 2016 for it to have been five years of non-activity? In which case Crown's record label and whichever publishing company owns the Sugababes rights could simply release 'Sugababes: The Ultimate Collection' in the summer and that would count as activity of the name? I don't know how this all works lol.

I'm not particularly bothered who gets the name, I don't think it will help MKS personally, but Crown legally owned the name where Keisha never has so that's surely got to give them some leverage?
