An eagled eyed fan on one of the Facebook groups has spotted the status of the Sugababes trademark has changed

The status is now "Registration cancellation pending"


This means that either crown has requested a cancellation of the trademark (probably in negotiations with Keisha) or Keisha's evidence submission to the EU was f***ing solid gold plated shit that suggests Crown applied for the trademark under false circumstances and should never have been the legal owner of it (i.e. Crown & the replacements never had the rights to the name. I had been thinking that any contract that gave up rights to the name that was signed before the origibabes all turned 18 would be easily contested in court under English Common Law)

Done some digging.

Keisha has filed a cancellation order on Crown's trademark on the grounds that they haven't used it in 5 years. The EUTM have accepted Keisha's claim under the relevant set of rules and Crown have until 8/4/17 to prove to the EUTM that they have been using it within the last 5 years. Failure to submit evidence means the trademark will automatically be revoked. They'll also revoke if there are no "proper reasons for non-use".

Freedom was released 25th September 2011 meaning it's more than 5 years since any activity under the Sugababes brand and Crown have basically no legitimate grounds to hold onto the trademark.

So the name will return to our lord and saviours hands allowing them to come back this year w00t.gif

Love love love that Keisha is so hell bent on (rightfully) getting the Sugababes trademark - if she's fought this hard for the name it makes me excited as to what could possibly be in the pipeline.

Deadline is tomorrow and there has been no rebuttal submission by Crown as of yet. If nothing is received the trademark is automatically killed.

Keisha has also been very Keisha and tied her cancelation notice to the opposition Crown made to her application. If Crown lose the trademark then there is no opposition to Keishas trademark request and it will be granted.

That depends. They aren't known for vigourous stage productions are they? Nothing stopping a pregnant siobhan sitting on the GMTV sofa chatting about the new babes album and getting compliments on how radiant she looks.

Sure we're now more likely to get music in 2018 but hey TIMW was recorded while Muts was pregnant and Tahlia wasn't that old when Push the Button was released

In a way, I'm happy Siobhan is pregnant if Crown are going to drag out this mess longer. At least she can get that out of the way if they ever do plan to come back.

They will be back, you can see Keisha doing the necessary leg work on her snapchat to keep them ticking over.

This will ensure Siobhan has given birth before a comeback though which is a bonus. Although lets be honest even if Keisha had won this month they wouldn't be back before Siobhan popped.

Probably looking at Q4 or Q1 2018 to allow Shiv to give birth and for the legal shite to be sorted.

June 8th just around the corner! No evidence submitted yet and the EU won't grant another. If its not submitted on time then Keisha wins automatically.

Keisha and Mutya have had a couple of meetings recently things look like they are ticking over nicely and Shiv looks v.v.prego.


If they win we'll start to hear news a little after that I think by way of a statement to the fans. Likely a "We've got our name back! Ta for keeping with us. Sooooooon. We love you. Soon. Shiv is up the duff. Soon. Music will be released when Shiv pops. Soon"

I'm assuming Siobhan's at least six months along? To be fair, she couldn't have picked a better time to get preggers as in if they win they'll still be several months away from releasing. I'm assuming that in the best case scenario we'll see a something in early 2018.

I once joked about how I hoped they would release something before I turned 30... well, I was 27 then and I'm 33 now. Whoops!

She looks like she's 6-7 months in yeah. I think we might see them in the studio and stuff again this year. I doubt we will get a Q4 release though, too competitive. Q1 I agree is much more likely.


Hopefully they get it done before my 30th! (I'm also saying this as a 27 year old)

Crown have submitted around 450 pages of evidence. This has now been provided to Keisha's legal team. They have until mid September to respond.

Luckily by the time this is all sorted and wrapped up Q1 2018 will be here, Siobhan will be coming towards the end of her maternity and things can FINALLY get f***ing moving again.

450 pages of evidence isn't a good sign for Crown - normally if you were confident you'd keep things short, even in legal matters. It would be interesting to see what those pages contains.

Purely speculation but I would imagine that it contains full copies of their contracts with Spotify and Apple et al for using the name and the back catalogue. Those'll be lengthy. There's probably the record deal with Island and the three album distribution deal with Sony that never actually released anything they'll no doubt claim is active.

A legal strategy is to bury people in paperwork and hope they can't afford to continue because of the cost of wading, try and run the clock out or get them to see the submission and give up. They've clearly forgotten what it's like to work with Keisha.

Think you're very much correct about the submission length. The fact they had to get an extension isn't a good sign for them either

Oh yeah. Latest update.

This is currently suspended due to a legal case involving Crown and Keisha in the UK Courts. I can't find Crown vs Buchanan anywhere and the Civil Courts aren't the most transparent about what is on their docket mad.gif so who knows. I am assuming that Keisha is suing them or something in the UK Court for ownership of the name.

I was a big fan of all six Sugababes, however why are MKS persisting with this legal action? Whichever members release a song as the "Sugababes" will do f*** all commercially anyway, so if they're making music for the fans/their own enjoyment, why don't they just get on with it under the MKS name instead? It's four years since 'Flatline' fell flat in a chart that was far easier to get a hit out of and I certainly don't see a Sugababes 5.0/1.0 doing any better. And 'Flatine' was a seriously GOOD song. Hope I'm wrong!

More twists and turns than a Stephen King novel.... all the paperwork apart from the initial notification of cancelation have been removed from the European Trademark site
