Shake It Off topped music charts around the world and reached number two in the UK. The video for the song has been watched more than 1.1 billion times on YouTube.

Mr Braham - who goes by the stage name Jesse Graham - claims he has copyright ownership of the phrases "haters gone hate" and "playas gone play", which appear in the chorus of Swift's song.

In Mr Braham's song, the chorus comprises: "Haters gone hater, playas gone play/ Watch out for them fakers, they'll fake you everyday."

The chorus of Shake It Off features lyrics including: "Cause the players gonna play, play, play, play, play/ And the haters gonna hate, hate, hate, hate, hate." She sings another line: "And the fakers gonna fake, fake, fake, fake, fake."

Apart from the lyrical similarity, the songs bear no resemblance musically.

Mr Braham, 50, told the New York Daily News he believed there was "no way" Swift could have penned the lyrics independently of his song.

"Her hook is the same hook as mine. If I didn't write the song Haters Gone Hate, there wouldn't be a song called Shake It Off," he said.

He added he had spoken to Swift's record label, Big Machine, four or five times about the issue.

He originally asked to be named as a writer and requested a selfie with the pop star, but was repeatedly dismissed and told his claim had no merit.

"At first I was going to let it go, but this song is my song all the way," he said.


Okay so there have been some ridiculous plagiarism lawsuits in the past but this is about the most frivolous one yet - this complete nobody with a song that doesn't seem to even be on YouTube (so I can't even laugh at it! damn) thinks Taylor Swift plagiarised him because she made a song that used the same meme phrase as its hook. Because Jesse Braham is literally the inventor of 'haters gonna hate'.

Hopefully this will be thrown out of court as it clearly should be, but the ruling on 'Blurred Lines' makes me worry it might actually be taken seriously.

Crying that this drama is going over the lyrics "haters gonna hate hate hate hate hate",

out of all the incredible things Taylor has written, it's not like this is really groundbreaking original stuff :')

Agreed this is stupid and the lyrics are barely similar at all. Just like when Owl City and Carly Rae Jepsen got sued for allegedly sampling Ally Burnett's Ah, It's A Love Song which had f*** all in terms of similarity and it wasn't dropped until a couple of years later :/

I saw an interesting thread that this has reminded me of.. Why does Taylor often get a lot of internet stick/targetting for writing songs about her (many) ex-lovers but Adele is applauded and loved for it thinking.gif I suppose Adele is a bit more ~graceful~ with it though Lol which answers the question.

On the OP there are scary similarities between that totally original saying and Taylor's lyric so i think this might be a sticky one ohmy.gif

Tenuous! Words cant be copyrighted or most songs would be guilty of using 3 words somebody else has already used.

I love you. I hate you. Proving someone cant independently create phrases is going to be difficult especially when many songs quote the titles of other songs in the lyrics without copyright problems...when do i get to sing "my way"?

It would be ridiculous if he actually won this lawsuit, I doubt it; even after the Blurred Lines case. Maybe they'll come to some agreement but hopefully he gets nothing from this.

I see the similarities but I don't think it's enough for a law suit laugh.gif

With the amount of songs out there that are complete rip offs 5 Seconds of Summer's Social Casualty > Sugar We're Going Down by Fall Out Boy for one and don't get even a glance from the courts yet, this is some big issue rolleyes.gif
