In March last year, Marvin Gaye's family was awarded $7 million after winning their claim over "Blurred Lines" allegedly ripping off "Got To Give It Up". They have clearly spent the entirety of that amount, because they are at it again. This time, they are hoping to get some money from Ed Sheeran, who, according to them, copied the "heart" of "Let's Get It On" for his 2014 megahit "Thinking Out Loud". Sheeran's spokeperson has yet to comment. Sheeran is currently embroiled in another suit with Martin Harrington and Thomas Leonard, who claim that his 2015 hit "Photograph" is a copy of Matt Cardle's "Amazing". This lawsuit has nothing to do with Marvin Gaye's family. It's the family of Ed Townsend, who co-wrote the song.

Songs are no way similar.
Gaye family everyday searching youtube and trying to find some 'alimony' It is like accusing random man on the street of paternity. If they have 'tool' why not py them I wonder how on earth did they get sentence - judges or jury were 100% black? Only in these circumstances. BTW taking a melody should be not penalised few months after song leaves chart. Plagiator contribute towards greter exposition of original artist and help him to sell more. Why should they pay for this. It is rather cover artists should be payed for increasing popularity of the 'original' at least after original hit has been forgotten |

The Gaye family make out like someone has dug up Marvin' body, put strings on it and used it as a puppet in a music video.
Notice again that people who want to sue only realise songs are 'similar' long after they've made a lot of money... |

The same can be applied to him. It's just seems so money-driven when they wait so long to sue opposed to them genuinely caring that they think their song has been copied.

"Copied the heart of 'Lets Get It On'"? Is this person actually FOR REAL!?
This really does not sit well with me tbh. I'm not even that big of an Ed fan! No one is safe in the music industry nowadays if this gets through. I think Prince's family should sue Adele for the emotion of 'Someone Like You' being similar to the emotion in 'Nothing Compares 2 U' It's such a "grasping at straws" reason! I really hope they fail. |

I could totally see the similarity between Photograph and the Matt Cradle song
but cannot see it here... I keep listening but I fail to see any similarity at all... but also didnt see it between Blurred Lines and the other Marvin Gaye song |

I think the law has always been 5 sequential notes and it's plagiarism. Purely by chance someone is going to do that, while some will do it unconsciously, some consciously. Law suits are nothing new, George Harrison was done for My Sweet Lord having 5 notes in a hook the same as He's So Fine by The Chiffons way back when.
I do agree that once the songwriters have died the songs should become public domain after a suitable amount of time - though publishers might take a different view. Only big hits get sued cos it's not worth the cost of lawsuits if the reward is small and the record hasn't made much money. Big stars take that risk - even Paul McCartney had a lot of soul-searching over Yesterday - he was sure it must have been an old tune when it came to him in a dream, so he checked. It wasn't. The previous Gaye family lawsuit was totally going to happen the moment Blurred Lines was released. I even commented in my blurb the week I first heard it and charted it that I hope they had gone for sample permission it was SO blatantly a copy, Robin Thicke had said time and again he was a huge Marvin Gaye fan. All they had to do was purchase the sample rights and they would have made much more money, so I don't have any sympathy. Ed Sheeran's? Can't say I'd noticed any similarity except mood, and that it's not worthy of comparison Ed should win the case... |
