Death is not an appropriate punishment for burglary. Not for the courts to hand out, no - but this was about self-defence. This is not America though, he was owning a gun illegally, and self-defence shouldn't be a justification for killing - he deserves jail time.

He probably will get jail time for illegal gun possession, but not for killing in self-defence, since that is something that you can't premeditate - it just happens accidentally. |

Using lethal force to defend property is not a legally acceptable defence for murder or manslaughter and he will rightfully go to jail.
Being burgled is horrid but the offender should be rehabilitated, not f***ing killed. If you end someone's life, you go to jail. End of discussion |

End of discussion If *all* that happens is that you are being burgled, I'd agree with you - but if they attack you (as I believe happened in the case in point), are you supposed to let yourself be killed? I don't have an issue with fighting back and defending yourself. I have an issue with lethal force being used in that process. Firearms are fortunately illegal for the most part here and that means that a scenario where you would be significantly disadvantaged is unlikely to occur.

Defending yourself is one thing - doing so with an illegal firearm is a bit different.

People are entitled to defend themselves, but they aren't entitled to kill, for good reason. If someone hit me and I killed them, I wouldn't be able to just pass it off as self defence, and rightfully so.

Indeed - and that's why the issue of proportional force is a factor in the CPS deciding whether claims of self-defence are legitimate. If an intruder hits you, and you hit him back, knocking him unconscious, that would be OK - but if you then beat the shit out of him while he's lying helpless, that would be counted as excessive force, and you'd be in big trouble! |
