Chili Peppers accused of plagiarism

DigitalSpy Wednesday, May 24 2006, 16:25 BST - by Matt Houghton

Rock band the Red Hot Chili Peppers have been accused of plagiarism by a radio station in the US.

The station WGMD, based in Delaware, has produced compelling evidence that the band's new single 'Dani California' is a rip-off of the Tom Petty track 'Mary Jane's Last Dance'.

The show's producer Jared Morris said "The chord progression, the melody, the tempo, the key, the lyrical theme...they're identical."

The presenter of The Morning Show has produced an MP3 example of the two tracks to help people make up their own minds.

However.....

Billboard.com - Saturday May 27 2006 Breaking news....

Tom Petty has instructed his lawyers to go to court to request a royalties injunction regarding the similarities between Red Hot Chili Peppers current single 'Dani California' & Tom Petty's Billboard Top40 hit from 1994 'Mary Jane's Last Dance'.

Decide for yourself.... here is the Video to Tom Petty's Mary Jane's Last Dance

Do you think RHCP are guilty of plagiarism or not?

Personally I think RHCP should settle out of court because they have clearly ripped off the verse of Dani California from Tom Petty, but have just speeded the track up!

Yeah they do sound very similar but it would be much easier for them to just settle it 'out of court'.
