May 7, 201114 yr Most of these cases don't get anywhere near court and those that do often end in defeat for the claimant.
May 7, 201114 yr Author Most of these cases don't get anywhere near court and those that do often end in defeat for the claimant. Good! Its crazy she can even make a claim in the first place.
May 7, 201114 yr My exam on this area of the law is on Monday. She'd be lucky to get £6m even if she was going to win, in fact the judge would probably only give her a few thousand. Anyway, as the article says, she accepted the risk, especially as she should have known about it as she'd been in the pool! Therefore, should be no liability. Although I'm probably wrong and I'll fail my exam on Monday...!
June 18, 201114 yr If anything like this happens to anyone who's dumb enough to get so drunk shouldn't get a penny. If they weren't drunk it wouldn't have happened. The person to blame is the one who's got drunk. And if while they are so drunk that they get seriously injured and cause damage in the process it is the innocent person who should be able to make a claim against the drunk. We all like to get merry from time to time, but if you go binge drinking and end up so drunk then you should accept the consequences.
