CMG Worldwide - the licensing agency that helped Madonna to secure the rights to use images of the stars mentioned in the "Vogue" rap on the backdrop screens during her MDNA Tour - is suing Marlon Brandos estate from breach of contract as they backed out of the tour licensing deal.

When Madonna performed "Vogue" at the Super Bowl in February, she paid a fee of $3,750 each to the dead celebrity estates. When the tour was launched, the fee per star was upped to $5,000 per appearance, but Brando Enterprises' legal team insisted on $20,000 instead. An additional problem comes from the fact that each celebrighoul entered the agreement with a "most favored nation" clause. This means that they're all paid the same no matter what, and also that, if Brando's estate scores $20,000, all the other fees will have to be raised at the same quote, and the cost per show to include those images in "Vogue" could suddently raise to $200,000 total, give or take.

 

CMG sued Brando for breach of contract, and Brando's team have moved the case to a federal court in Indiana. CMG is asking the judge to keep their cost at $5,000 per appearance - which would still mean at least $300,000 for Brando's estate overall.

 

Brando Enterprises argue that Madonna has violated the actor's intellectual property rights during nearly 90 different shows: "Despite the fact that plaintiff is asking the Court to award it the Brando IP Rights for a mere $5,000, the true value of those rights in this litigation exceeds three-hundred thousand dollars."

Madonna puts on a hell of a show, but you still wouldn’t want to be stuck in an elevator with her. Judging by last night’s events at Vancouver’s Rogers Arena, if Madonna ever hands you a microphone and asks you to sing, you better live up to her standards.

'You really don’t know the song,' she snapped after holding the mic in front of a befuddled fan midway through 'Open Your Heart', 'Shame on you!'

In the heat of the moment it was pretty funny, but Madonna had clearly taken it personally. She continued her haranguing at the song’s conclusion.

'You’re wearing the t-shirt that says Open Your Heart. I hand you the mic and you don’t sing. What the f***?'

Changes on the second night at Madsion Square Garden

 

Madonna treated her fans and the Madison Square Garden tonight with a fantastic MDNA show filled with surprises.

The biggest, unexpected addition to the show was a special rendition of "Give It 2 Me" that ended up being mixed with "Gangnam Style", and a special appearance of Korean music sensation Psy.

 

Psy had a chatty moment with Madonna before the two went on with another special surprise, performing "Music"!

On a side note, "Masterpiece" was not performed, and there was no mash up of "Give It 2 Me" during the closing number "Celebration".

Madonna 'Gay Propaganda' suit thrown out by Russian Court

Madonna did not break city laws on the promotion of a homosexual lifestyle among minors during a concert in St. Petersburg earlier this year, a court ruled on Thursday.

 

"Madonnas actions were planned and aimed at the formation of a distorted view of personal relations," read the lawsuit, which was dismissed after a six-hour-long hearing by the St. Petersburg court.

The nine plaintiffs were claiming over $10 million in compensation for "moral damages" suffered during Madonnas concert in August, during which the star handed out pink bracelets to the crowd in a show of unity with the citys gay and lesbian community.

 

The organizers of the concert had stated that entry to the concert would be barred to anyone under 18 years of age.

The authorities had earlier refused to open a criminal investigation into the allegations.

 

"St. Petersburgs laws were brutally violated and in the coming years this type of violation could become the norm," plaintiff Marina Yakovlyeva told the court. "But we have created a precedent any artist coming to our city will know now what laws exist in our city."

The plaintiffs also said Madonnas "gay propaganda" would lead to a deterioration of Russias demographic crisis and its subsequent inability to man its army. They also said her promotion of homosexuality would lead to an increase in divorce rates.

 

But the judge at the trial was unimpressed.

 

"How many families split up because one of the couple is gay?" asked Judge Vitaly Barkovsky. "And how many because of alcoholism? How many lawsuits have you filed against alcohol companies?"

 

The plaintiffs were backed by St. Petersburg lawmaker Vitaly Milonov, who authored the citys "gay propaganda" law. The law, which was passed in March, criminalizes "public action aimed at propagandizing sodomy, lesbianism, bisexualism, and transgenderism among minors." Those charged with breaking the law face fines from 5,000 to 500,000 rubles.

Despite a court summons, Madonna did not attend the hearing, which attracted intense media attention in Russia. A spokesperson for Madonna was not available for comment on Thursday.

The courts ruling deflected further potential criticism of Russias judicial system, which was the subject of widespread international condemnation in the wake of the jailing of anti-Putin punks Pussy Riot for two years apiece in August.

British actor James D'Arcy, who plays Prince Edward in Madonna's "W.E.", talking to Celebuzz and explaining how he's good friends with the director, which seems to shock a lot of people.

"I'm good friends with most of the directors I work with. People are only amazed because it's Madonna, like because she's Madonna she doesn't have friends which is ridiculous if you start to think about it."

 

James also mentions how he's featured in Madonna's MDNA show, that he attended in London last Summer.

 

"On the screens she plays four minutes of outtakes from the movie of me and Andrea (Riseborough) rolling around on the beach while she sings "Masterpiece", her song from the film," he explains. "After the show I went to a party at her house."

Madonna concerts outsell Lady GaGa 3 to 1 in Latin America

 

The statistic is even more surprising when taking into account the fact that tickets for Madonna's 'MDNA' shows are three times as expensive as those for GaGa's concerts.

The Examiner reports that GaGa's South American dates have had lacklustre sales considering the size of the venues she was booked into.

GaGa claimed her Peru show had an audience of 50,000, whereas actual ticket sales were reported to be around 17,000, with many tickets for the show being given away free as part of a buy-one-get-one-free deal.

Many of GaGa's Latin American shows also suffered from similarly low turnouts. However, Madonna regularly played in the same area to sold-out crowds of more than 55,000.

GaGa's tours have fared much better in Europe and South Africa, and the 26-year-old is set to launch her 'Born This Way Ball' tour in North America next month.
