'Better Man' was a single (and one of his biggest hits!) in Australia and New Zealand, so it wouldn't be eligible, as it has to be purely an album track that wasn't released as a single anywhere.

Can we have a decision from whoever is in charge of this then, I think it's a ballad , if not we will put something else forward, it's no big deal , it's only a bit of fun... can someone let me know before deadline this evening if there is an objection
