We've always used our discretion for samples, the new framework just codifies it. We're not going to kill something just because it's a sample. We check it out and see what impact it has on the song and then be reasonable.

Thanks, btw, while there's lots on samping I couldn't see anything in the framework about covers of non-BJSC entries. What's the stance on those, if they are covers of relatively well-known songs? For example if I was to send a straight death metal or otherwise inspired cover of a very well-known song, how would that be treated?

Yeah this is where discretion comes in. If you're sending a cover of that Ed Sheeran pile of shite that's at number 1, for example, we're probably gonna tell you to get stuffed - no matter how different it is. Just coz the song being covered is reasonably new and everywhere.

 

For older songs we judge how big the original was, how different the cover is and what sorta hype the cover itself has received.
