I much prefer this, although it does still have Frankie's awful line; luckily we won't be hearing that anymore though :D

I actually think if that happened Amelia could win :o Tbh I think that would be unfair though (although Amelia is by far and away my fave this year) because they have missed a huge chunk of the competition, and it wouldn't be right for them to just leapfrog it all, especially if they won.

 

I'd love it if Amelia had a chance to return, but the only fair way of doing something like this would be to allow Sophie, Johnny, The Risk, Nu Vibe and the other top 12 eliminees in the vote too!

I think Jony should be allowed back full stop. As much as I ADOORE :wub: Amelia, I would find it really unfair if she leap-frogged a whole bunch of other contestants... Maybe let the judges pick one act each (doesn't have to be their own) and let the public vote :P

If they bring back another contestant than that will only make me more convinced that Frankie was a publicity stunt from the moment he first dropped his trousers on the auditions to the moment he walked out. I wouldn't be surprised to find out that somewhere - Frankie has an Equity card.

This won't be happening surely? Imagine how pissed off Johnny, The Risk, Sophie, etc. would be. :o

Why not? They weren't up for the public vote so it was unfair to judge how well they'd do. Johnny, The Risk*, Sophie and the like were all up for the public vote and failed to connect with the audience. This way the X Factor could get more money from the public who will vote for who they want back in, without having to give refunds and what not because it's not like the public had already voted for these and voted them out or whatever.

 

I personally think it's the only way that's fair. And I'm not convinced Amelia would get it anyway. Jonjo is TOO well liked. (So maybe it's for the best this doesn't happen? :lol:)

 

* - although with the reports of their phone lines bodging up, then fair enough, let them back (although I'd really hope not!)

Rhythmix and the X Factor: Part 2

 

Well, here we are again.

 

To summarise; on 23 September 2011 Simco (a company largely owned by you) tried to take control of the identity Rhythmix for use by some contestants on The X Factor UK using trademark methods available to them in Europe. Simco and X Factor did this in the full knowledge that "Rhythmix" was an existing trademarked name of a music charity that works with vulnerable young people. The use of the name was announced on the X Factor on 1 October, and the Charity wrote to Simco, Talkback Thames, ITV, Syco, X Factor and their legal representatives repeatedly in the subsequent three weeks asking for the name to be changed or for Simco to stop seeking to control the identity. On 26 October at 9am we wrote publicly to you personally asking that all the people involved in the programme stop pretending that the Charity was causing a fuss about nothing and simply change the name. At 5.43pm that day the name of the girl band was changed.

 

Many people reading this new open letter will immediately be thinking "well, what does this Charity want now? They've changed the name". Unfortunately, whilst your company Simco and your programme The X Factor have managed to stage a PR event publicly changing the name of your contestants, actually the legal position hasn't changed at all, and neither has the outcome for the Charity.

 

Firstly, despite writing repeatedly to your legal representatives for two weeks asking that the public announcement of the name change be replicated by the actual action required (withdrawing the trademark application) as of 8 November Simco are still seeking to exclusively trademark the name Rhythmix - a copy of your application can be viewed online here: http://esearch.oami.europa.eu/copla/trademark/data/010288843

 

There can be only two reason for this. 1) Simco intend to change the name of the band back at some future date or 2) Simco and/or its legal representatives want to use their control of the identity to force the charity to accept terms and conditions before permitting the Charity to continue to trade.

 

Secondly, Simco and your legal representatives are choosing not to respond to any of the formal letters sent to them. This is despite the legal problems between your company and the Charity being caused entirely by the actions of Simco, despite the thousands of pounds in legal fees that are the responsibility of Simco, and despite the failure to conclude the matter properly. Why won't they respond? Because the legal advice is that the Charity cannot afford to pursue Simco through the courts, so the best way to "win" this matter is to not deal with it and wait for the Charity's money to run out.

 

Bluntly, that legal advice is correct. This Charity isn't prepared to spend thousands of pounds forcing Simco to "do the right thing". We won't be sending you any more legal letters. We won't be asking Simco any more times not to take our identity. We won't write any more letters to you or to Simco asking that you or they cover the unjustified legal costs they have forced upon the Charity.

 

Whether you eventually complete your trademark application or not, the Charity intends to continue to stage Rhythmix concerts, make Rhythmix recordings, and print the word Rhythmix on paper and t-shirts. We won't ask your permission, and if you or your company seek to prevent the Charity in engaging in its normal activities we will simply notify the public of your actions and let them decide what should be done.

 

The legal costs are £8,000. This is equivalent to 120 hours of music making and social interaction for vulnerable young people that benefit from the Charity's work. It is , coincidentally, equivalent to roughly three seconds of advertising time during the X Factor. Since Simco don't apparently feel that their actions are their responsibility, we therefore invite any of your main corporate advertisers to consider cutting their advertising with X Factor by a full 3 seconds and donate that money to cover the legal costs Simco generated. The actions taken and the attitude displayed by Simco throughout this matter demonstrate a level of arrogance and lack of responsibility that we believe should concern you as the public face of the company. You can choose to take an interest in this matter or you can choose not to. Whatever you choose to do, the aim of this letter is to ensure that both you and the public are fully aware of the actions of your company.

That Rythmix Charity is pushing it a bit far now. Little Mix will obviously not take that name back, and I don't think the X Factor cares at all about that name now. If anything it's just that it takes times to go the other way round legaly but I really think they're gonna drop the name for good.

To me it looks like that Charity wants to get more publicity and more donations...

I don't see why anything in there would be false. If it is, then surely the charity would have a lot more to lose because the X-Factor or Simco could sue them for some form of libel or whatever? It would certainly cost a lot more than the relatively small amount they're asking for.

 

If they didn't care and it does take time, then either A) surely the charity would know this or B) they'd actually tell them instead of repeatedly ignoring them?

I don't doubt the charity's intentions; I don't think this is simply a let's-cry-for-publicity moment. They've already alluded to the fact that they KNOW they can't afford the funds for a legal battle, so going public is the only option they have.

 

However I would be very surprised if Simco really WERE intending to take the name back. Let's face it, if (and there is about a 1% chance of this happening) Little Mix win the contest, they'll be doing so as Little Mix. It would be MADNESS to try and THEN go back and re-market themselves again.

 

 

 

 

In other news, the theme this week has been confirmed to be LADY GAGA and QUEEN. Quite what connection there is there I can't fathom, but I assume it's there for the likes of Janet, who let's face it, ISN'T going to be doing a disco anthem anytime soon again.

Misha's song was leaked on Twitter last week too and ended up correct :D But she was meant to be doing Disturbia the other week and ended up with Tainted Love :P It's 'Queen vs. Lady Gaga', but we still don't know if that means they sing either Gaga or Queen or that they do a song by each act.

I don't think that includes Amelia, it says 'eliminated before live shows' so I imagine each judge will choose one contestant from their 4 rejects to compete for the place.

 

I think it will end up with Jade, Joe, Esterelles maybe? (dunno about the groups, because The Keys are f***ed up now Charlie left, they can't re-instate him :unsure:) and Carolynne, and obviously Jade will get the spot.

That does seem unfair, I understand if it was Amelia, Jonjo, 2 Shoes and James - but I don't think they should go back that far (unless Carolynne gets through!)
