July 15, 201312 yr Phixx (aka the lot that weren't One True Voice) showed up at #9 in midweeks in June 2004 with their cover of "Wild Boys" by Duran Duran but it was #12 by Sunday because their CD2 was longer than the rules would allow. Another one disqualified after a midweek position of #13 was 'Industry' by The Modern in 2006 - although this was largely due to their fans bulk buying excessively that killed that off.
July 15, 201312 yr Pop! - Heaven and Earth would have gone top 10 but fell out due to discounted sales. Shame as it was a great track
July 15, 201312 yr Of course, the biggest crop of 'missing' sales was in late 2006, when songs whose physical single had been deleted, got their download sales excluded from the chart. :( I will never understand those UK chart rules from 2006 with songs exiting the chart completely two weeks after the CD single was deleted. How can anyone justify Gnarls Barkley 'Crazy' having a UK chart run of 01-01-01-01-01-01-01-01-01-02-05-OUT. :manson: It really was the most bizzare chart rule to ever exist. At least 'Crazy' didn't actually lose its sales in those 30 or so weeks when it clearly would've still been in the UK top 40 under the 2007 chart rules. Just a shame they didn't implement the 2007 chart rules earlier in 2006.
July 15, 201312 yr Kylie's 'Hand On Your Heart' had some sales disqualified due to an issue regarding cassettes, which meant it debuted at #2 instead of number one. Although the rule changed following this and it climbed the following week. Just wondering, do disqualified sales at the time later get added? Perhaps if chart rules changed which meant they would become eligible?

Perhaps if chart rules changed which meant they would become eligible? Certainly not on historical stuff (pre 1994) as the OCC wouldn't have the data. The tracks that are given away as part of a pre order for an album wouldn't as well- they would only "count" when you "complete my album" and count as an album sale, the question over the 06 rule in relation to being connected to a physical release was (I think) that download sales would be added to a "total" but it would not be eligible on a weekly chart basis if that makes sense?!

That's what I was thinking for the 2006 rule, I guess we could easily find out by adding up the weekly eligible sales for 'Crazy' and see if this equals its year end total.
July 15, 201312 yr That's what I was thinking for the 2006 rule, I guess we could easily find out by adding up the weekly eligible sales for 'Crazy' and see if this equals its year end total. Yes it sold just over 700k whilst in the charts but over 800k by year end! Mystery solved :D
July 15, 201312 yr The tracks that are given away as part of a pre order for an album wouldn't as well- they would only "count" when you "complete my album" and count as an album sale Although this rule no longer applies anyway thanks to David Bowie. Presumably though previous examples aren't going to have the sales retroactively inlucded in their totals, meaning 'Paradise' has lost over 100k sales that would now have been counted as legitimate (unless I'm mistaken and they are included now?)
July 15, 201312 yr Nicki French 'For All We Know' - Initial midweek of #17 but ended up charting at #42 due to a barcode issue which affected copies sold at Woolworths, Nicki French 'Is There Anybody Out There' DQ'd due to chart fixing [she was on the same label as Tatjana who had the same happen to her track]. both on Love This Records, wasn't the label owned by Stock & Aitken (without the Waterman) :)
July 15, 201312 yr This is true - the CD single included three mixes of the lead track, which under the rules of the time wasn't eligible, so it charted only on 12" sales. I think the specific problem was the inclusion of the B Side after three versions of the single? This was the track list: 1 I Would Die 4 U (Original) 2:38 2 I Would Die 4 U (Club Edit) 3:00 3 I Would Die 4 U (Club Mix) 5:25 4 Always & Forever 4:51 If the track lists had been either of the following, there would have been no problems: 1 I Would Die 4 U (Original) 2:38 2 I Would Die 4 U (Club Edit) 3:00 3 I Would Die 4 U (Club Mix) 5:25 (Even more 'I Would Die 4 U' remixes could have been included beyond this, as long as it came to a running total of under 40 minutes, I believe?) (or) 1 I Would Die 4 U (Original) 2:38 2 I Would Die 4 U (Club Edit) 3:00 (OR) I Would Die 4 U (Club Mix) 5:25 3 Always & Forever 4:51
July 15, 201312 yr Does anyone actually know what the official sales of Paradise are? I see over 900k quoted, but does this include all those ineligible sales, and if so, what is the official lower sales total please?

Yes you're right - I meant to clarify that but sometimes if the computer freezes up in mid-sentence I get distracted... It was the inclusion of three mixes and another song that was the problem. A remix single could indeed feature any number of versions of the same song up to 40 minutes, but as soon as there was more than one song you were down to three tracks and 20 minutes. The rules were later simplified.
July 15, 201312 yr At the time of I Would Die 4 U's release, the limit was 20 minutes no matter what - I believe it was not until 2003 that the limit for remix CDs was extended to 40 minutes. Edited July 15, 201312 yr by paulgilb

I dream of Kylie being a new entry at #2 these days!
July 16, 201312 yr Does anyone actually know what the official sales of Paradise are? I see over 900k quoted, but does this include all those ineligible sales, and if so, what is the official lower sales total please? I have it on 967-968k, which *includes* the ineligible sales.
July 16, 201312 yr I seem to remember some song by Pop! being effected by these rules, was CD2 of Heaven an Earth disqualified perhaps, leading to a debut outside the top ten? Not 100% sure but it rings a bell. I loved I See Right Through To You, gutted it was disqualified! Pop! - Heaven and Earth would have gone top 10 but fell out due to discounted sales. Shame as it was a great track Sales of the 2-track single were only discounted from the second week onwards. OCC were only alerted of the problem after they had already published the chart when it went in at #14, so they let the chart stand.
July 16, 201312 yr I suppose all the X-Factor contestants weekly performances loaded onto iTunes since 2010 would've been eligible to chart had they not been excluded at Syco's request. I hope they don't follow the Voice's lead by letting them chart this year, as combined with original track and guest performers boosts the chart would descend into farcical bedlam.
