I would have been surprised if David Bowie was chart eligible, even if it is slightly different to Paradise and Give Me All Your Luvin''s pre-order thing. Pitbull should finally get Top 10 with Don't Stop the Party! Wasn't expecting a Top 20 return for Anything Can Happen (don't buy this guys, Figure 8 needs help!!). Would be great if Bon Jovi could climb from its midweek position, but it's now falling on iTunes (now #16), but Top 25 should hopefully be in store on Sunday (which is higher than their previous two lead singles I think someone mentioned).

Good to see The Lumineers finally getting some progress on the album chart now that album downloads are currently having a bigger role. Also nice to see Taylor Swift back in the Top 40 - recent success of I Knew You Were Trouble should give the album a better chart run for a number one album. Frank Ocean to go back into the Top 20 please!

The US duo’s track, which has been in the Top 3 ever since it was released five weeks ago, failed to topple the 2012 X Factor winner’s debut single last Sunday, with Impossible holding onto the top spot with just over 6,000 more sales than Scream And Shout. In today’s Official Singles Chart Update, that lead is almost fully reversed, with Scream And Shout currently 5,000 copies ahead at this midway stage.

Thank the lord David Bowie is excluded. Great to see Scream & Shout finally heading for #1!

I'm not sure a re-think is needed. Per previous threads, my understanding is that people who pre-order the album get the track for free now - they pay the full amount for the album upfront. They are therefore buying the album and not the track, and so it should be counting towards the album chart when released. You can't have it counting towards the singles AND the album chart which reversing the rules would effectively do.

Of course, the single that is bought separately from the album should count, but per the OCC they don't have the ability to separate the sales.

But unless they are BS'ing about being unable to split free/paid-for Bowie downloads, they *couldn't* change...

Good to see the Alt-J album at #21 - The reduction in price on iTunes and HMV is helping so hopefully it will manage to climb a bit more this week and with AirPlay for their track 'Matilda' growing it could potentially go Top 10

It would be so artificial for them to change it now, just because David Bowie is doing better with this tactic than other artists have done before now. His label could have easily released it so it counted separately, but they chose not to.

Scream & Shout for #1. If another 'Blackout' scenario occurs I won't be pleased. <_<

MW mid report added for anyone that has missed it.

And in March no one will moan how big sales he will have in the albums with this strategy...

Rules are rules, like it or not. If whoever is responsible for marketing this single wanted it to be charge eligible they'd have released it as a separate single.

I'm more than happy that Bowie will be excluded. Will and Britters will 100% be #1 on Sunday :D Also great to see Vato top 20!

Chart rules exclude David Bowie track from midweeks

Source: MW

by Paul Willams

David Bowie's surprise comeback single Where Are We Now could miss out on a place in the UK singles countdown this weekend because of an issue over chart rules.

The single was rush-released by Sony's Columbia label at the beginning of this week and is presently sitting at No 1 on iTunes, which is exclusively selling it. However, it does not appear anywhere in the Official Charts Company's Top 200 midweek singles chart because the Charts Company sales some of its sales are related to a pre-order promotion for Bowie album The Next Day, which is out in March. Such sales are excluded from the chart under Official Charts Company rules.

In a statement, the Official Charts Company said: “Owing to chart rules which are agreed in partnership with UK record companies and retailers, data relating to the David Bowie single Where Are We Now cannot currently be counted towards the official singles charts, as the release is linked to an album pre-order promotion and it is not possible to distinguish album sales from track sales from the retail data received. Should it become possible in the future for regular track sales to be distinguished from album pre-order incentive purchases, then these sales can be counted towards the chart.”

The rule concerning tracks which are made available as part of a pre-order album promotion have affected other high-profile acts in the past, including Coldplay and Madonna.

Despite Bowie's possible exclusion from the UK singles chart, he is charting strongly on iTunes charts across the globe with the track. As well as topping the iTunes UK chart, it is No 1 at the retailer's Swedish store, 2 in Brazil and the Netherlands, 3 in Norway and Poland, 4 in Italy and Spain, 17 in Germany, 21 in Russia, 28 in Canada and 50 in the US.

The album The Next Day, which is released on March 12, is doing even better on pre-order on iTunes, topping the retailer's countdowns in territories including the UK, France, Germany, Brazil, Italy, Denmark, Spain and the Netherlands, at 2 in Canada, 4 in the US and 6 in Russia.

Great to see Ellie back in the top 20!! Doing incredibly well! Very happy to see Taylor's album back in the top 10 too!

Even if David Bowie did turn out to be eligible, surely missing the first 2 days of sales and his iTunes lead already decreasing would still mean Will and Britney would more than likely have got #1 anyway?

This little gem appeared in the MW report, just to add to the confusion...

One track not registering presently in the midweeks is Where Are We Now?, the surprise comeback single from David Bowie and being released by Sony's Columbia label. This is because of an issue over its sales data between the Official Charts Company and iTunes, which is selling it exclusively. It is hoped the matter will be resolved in time for the track to register in the full-week chart on Sunday.

twitter updates from @officialcharts seem to suggest they haven't made a final decision on Bowie eligibility yet...

No. They screwed "Give Me All Your Luvin'" from going top 20, they shouldn't revert their decision just because this has gone much higher than tracks with previous pre-order deals like this.
